How Paternity Is Established in Massachusetts

Massachusetts paternity law is governed by M.G.L. c. 209C, the statute addressing children born outside of marriage. There are two paths to establishing paternity in Massachusetts: voluntary acknowledgment and judicial adjudication.

Voluntary Acknowledgment of Parentage

The voluntary route uses an Acknowledgment of Parentage signed by both parents before a notary. If neither parent rescinds it within 60 days of signing, the acknowledgment carries the same legal weight as a court judgment. An acknowledgment executed when the child is six months or older, or one that isn’t rescinded within the 60-day window, waives the right to genetic marker testing. That makes timing and informed decision-making important before signing.

Judicial Adjudication

When either parent contests paternity, either may file a Complaint to Establish Paternity in the Probate and Family Court. Cases involving custody or parenting time must go to Probate and Family Court; support-only matters may proceed in district court. The case is filed in the county where the child or at least one parent resides.

Genetic Marker Testing & Court Orders

If paternity is disputed, the court may order genetic marker testing. The Massachusetts Department of Revenue can arrange testing at little or no cost depending on the parties’ finances. Massachusetts court time standards set a goal of resolving paternity cases within eight months, though individual timelines vary.

Once paternity is established, the court can enter orders for legal custody, physical custody, parenting time, child support calculated under the Massachusetts Child Support Guidelines, and health insurance coverage. Mothers who establish paternity through the courts may also seek retroactive child support dating back to the child’s birth.

What Legal Paternity Means for Fathers, Mothers, & Children

In Massachusetts, the mother is presumed to be the sole legal custodian of a child born outside of marriage. An unmarried father has no right to seek custody or parenting time until paternity is legally established, even if he is named on the birth certificate and has been actively involved in the child’s life. Once paternity is established, he can petition for legal custody, physical custody, and parenting time on the same basis as a parent in a divorce proceeding.

For children, the benefits extend beyond parenting arrangements. Established paternity opens access to the father’s health insurance, Social Security survivor benefits, inheritance rights, and paternal medical history. These practical consequences make paternity a matter of the child’s long-term welfare, not just a legal formality between the parents.
