Cape Cod Divorce & Family Law Attorneys

Lynch & Owens represents Cape Cod divorce and family law clients from Provincetown to Bourne in the Barnstable Probate and Family Court.

For more than 25 years, our lawyers have served the family law needs of Cape Cod residents. Our attorneys know the judges of the Barnstable Probate and Family Court, Hon. Robert A. Scandurra and Hon. Arthur C. Ryley. The lead attorney for our Cape office, Carmela M. Miraglia, has spent more than a decade serving the people of Cape Cod, and today acts as Lynch & Owens’ lead attorney for our Cape office in East Sandwich, Massachusetts. In addition, Lynch & Owens partner Jason V. Owens was born and raised on Cape Cod and served a judicial clerk at the Barnstable Probate and Family Court prior to entering private practice.

The Barnstable Probate & Family Court: Serving All of Cape Cod from a Singe Courthouse in Barnstable Village

Geographically, Cape Cod is a big place, stretching 63 miles from the Sagamore Bridge to Provincetown by car. However, all of Cape Cod fits within Barnstable County. This means that every divorce, child custody and child support case involving Cape Cod residents – from Bourne to Provincetown – takes place in a single courthouse, the Barnstable Probate and Family Court, located on Route 6A in Barnstable Village.

If you are a Cape resident seeking representation in divorce or family law case, you need a lawyer with experience in the Barnstable Probate and Family Court. Our attorneys have more than 40 years of combined experience in the Barnstable Probate Court. Don’t let geographic distance stop you from getting the representation you need.

We recognize that some of our clients from the outer Cape may be located as many as 50 miles away from our East Sandwich office. We accommodate our outer-Cape clients by conducting initial consultations by phone and holding key in-person meetings at alternate locations (such as other attorneys’ offices) that are closer to our clients’ homes on the outer Cape.

On-Cape Knowledge, Off-Cape Independence & Resources

Our Cape Cod clients have described the challenges of selecting an on-Cape family law attorney. With just two judges serving the family law needs of the entire Cape from a single court in Barnstable Village, clients tend to seek on-Cape attorneys who have inside knowledge of the personalities, politics and “unspoken rules” of the Barnstable Probate Court. However, our clients also report that on-Cape attorneys sometimes seem to lack independence from the small legal community surrounding the Barnstable Probate and Family Court.

Any attorney will tell you that maintaining a good reputation is essential for a lawyer. Reputation is twice as important when an attorney’s practice consists of appearing before the same two judges, at the same court, every day. Put simply, family law attorneys who practice in Barnstable County must carefully protect their reputations with the two judges who sit at the Barnstable Probate and Family Court. These attorneys sometimes face tough choices when aggressively advocating risks frustrating a Barnstable County judge.

Lynch & Owens provides our Cape Cod clients with on-Cape experience coupled with off-Cape resources and independence. From our main office in Hingham, we are the leading law firm on the South Shore of Massachusetts. Our attorneys bring decades of experience in Barnstable Probate and Family Court, as well as the resources and reputation of a respected off-Cape law firm.

Carmela M. Miraglia, Lead Attorney for Our Cape Cod Office

The lead attorney for our Cape office, Carmela M. Miraglia, has primarily focused her family law practice in Barnstable County for more than a decade. She’s served on the Barnstable County Bar Association Steering Committee, has been appointed as a Guardian ad Litem (GAL) and ARC attorney by Judges Scandurra and Ryley, and has close relationships with Court staff.

Unlike attorneys whose practices focus exclusively in Barnstable County, however, Attorney Miraglia regularly appears before more than a dozen probate court judges across Massachusetts. This mix of independence and experience provides Attorney Miraglia with inside knowledge of the close-knit legal community in Barnstable County while allowing her to approach cases with an outsider’s independence.

By combining the inside knowledge of an on-Cape attorney with the independence and resources of the South Shore’s family law leader, we offer our Cape clients the best of both worlds: inside knowledge and independence.

Representing Clients in Same-Sex Divorce and LGBT Family Law Cases on Cape Cod

We proudly represent clients in same-sex divorce and LGBT family law cases on Cape Cod. Massachusetts has long been a leader in LGBT and same-sex rights. Advocates from Boston to Provincetown led the charge for legalizing same-sex marriage in Massachusetts in 2004, a full decade before same-sex marriage became legal nationwide.

Lynch & Owens is a LGBT-friendly and gay-friendly law firm that is committed to serving the family law needs of the same-sex and LGBT community on Cape Cod, including same-sex divorce and child custody representation, from Bourne to Provincetown.

Representing Cape Cod Parents and Caregivers in DCF Investigations

Lynch & Owens is a full-service family law firm, which means that we represent parents, caregivers and guardians in a range of case, from child custody actions, to guardianships to DCF investigations. Our DCF services include representation of parents and caregivers during DCF investigations for neglect or abuse, as well as fair hearing appeals of supported DCF findings of neglect of abuse against parents and caregivers.

Cape Cod has been hit hard by the opioid crisis. As a result of this and other factors, DCF investigations of parents and caregivers for allegations of abuse or neglect of children have skyrocketed on Cape Cod in recent years. Our attorneys have experience representing parents who are subject to DCF investigations, as well as grandparents and other relatives who are seeking to take custody of children through guardianship proceedings in the Barnstable Probate and Family Court.
